Welcome to Genesis Security Dubai. These Terms and Conditions govern the use of our services and the relationship between Genesis Security Dubai (hereinafter referred to as “Company,” “we,” “us,” or “our”) and the client (hereinafter referred to as “Client,” “you,” or “your”). By engaging our services, you agree to comply with and be bound by these Terms and Conditions.
Genesis Security Dubai provides professional security services, including but not limited to:
3.1 Engagement: Services will be provided based on a mutually agreed Service Agreement, specifying the scope, duration, and fees for the services.
3.2 Modifications: Any changes to the Service Agreement must be documented and agreed upon by both parties in writing.
3.3 Termination: Either party may terminate the Service Agreement as per the termination clause specified.
4.1 Access and Information: The Client shall provide all necessary access and information required for the provision of services.
4.2 Compliance: The Client shall comply with all applicable laws, regulations, and safety guidelines.
4.3 Payment: The Client agrees to pay for the services as specified in the Service Agreement.
4.4 Cooperation: The Client agrees to cooperate with the Company to ensure the effective provision of services.
5.1 Professional Conduct: We will provide services in a professional manner, using qualified and trained personnel.
5.2 Confidentiality: We will maintain the confidentiality of any sensitive information provided by the Client, except where disclosure is required by law.
5.3 Compliance: We will comply with all applicable laws and regulations governing security services in the UAE.
5.4 Insurance: We will maintain adequate insurance coverage for the services provided.
6.1 Fees: Fees for services will be detailed in the Service Agreement.
6.2 Payment Terms: Payment terms, including due dates and acceptable payment methods, will be specified in the Service Agreement.
6.3 Late Payments: Late payments may incur additional charges as outlined in the Service Agreement.
6.4 Refunds: Refund policies will be detailed in the Service Agreement.
7.1 Liability: Our liability is limited to the amount paid by the Client for the services provided. We are not liable for any indirect, incidental, or consequential damages.
7.2 Indemnity: The Client agrees to indemnify and hold us harmless from any claims, damages, or expenses arising from the Client’s breach of these Terms and Conditions or any negligent or wrongful act by the Client.
8.1 Termination by Client: The Client may terminate the Service Agreement by providing written notice as specified in the agreement.
8.2 Termination by Company: We may terminate the Service Agreement for cause, including non-payment or breach of these Terms and Conditions, by providing written notice.
8.3 Effects of Termination: Upon termination, the Client shall pay for all services rendered up to the termination date.
We are not liable for any failure to perform our obligations due to circumstances beyond our control, including but not limited to natural disasters, war, or government actions.
These Terms and Conditions are governed by the laws of the United Arab Emirates. Any disputes arising from these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of the UAE.
We reserve the right to amend these Terms and Conditions at any time. Any amendments will be communicated to the Client and will take effect upon such communication.
12.1 Confidentiality: Both parties agree to maintain the confidentiality of all information received from the other party.
12.2 Data Protection: We will handle personal data in accordance with applicable data protection laws and regulations.
13.1 Negotiation: Both parties agree to attempt to resolve any disputes through informal negotiation first.
13.2 Arbitration: If negotiation fails, disputes will be resolved through binding arbitration as per the rules of the UAE.
14.1 Compliance: We will comply with all relevant health and safety regulations.
14.2 Client Obligations: The Client is responsible for maintaining a safe environment for our personnel.
15.1 Provision: We will provide all necessary equipment and materials for the services.
15.2 Maintenance: We are responsible for the maintenance of our equipment.
16.1 Ownership: All intellectual property rights in any materials provided by us remain with us.
16.2 License: The Client is granted a limited license to use any materials provided by us solely for the purpose of receiving the services.
We reserve the right to subcontract any part of the services, provided that we remain responsible for the performance of the subcontracted services.
Any notices required under these Terms and Conditions shall be in writing and delivered to the addresses specified in the Service Agreement.
These Terms and Conditions, together with the Service Agreement, constitute the entire agreement between the parties and supersede all prior agreements and understandings.
If any provision of these Terms and Conditions is found to be unenforceable, the remaining provisions will remain in full force and effect.
